End User License Agreement (EULA)

1. Acceptance of Terms

By downloading, installing, or using AI Notepad (“the App”), you agree to be bound by this End User License Agreement (“EULA”) and the App Store Terms of Service. If you do not agree, do not install or use the App.

This EULA is concluded between you and Vladimir Fedorov ("the developer"), not with Apple. Apple is not responsible for the App or its contents.

2. License Grant

The Developer grants you a personal, non-exclusive, non-transferable, limited license to install and use the App on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.

3. Restrictions

You may not:

• Sell, resell, rent, lease, sublicense, host, distribute, or otherwise commercially exploit the App.
• Modify, adapt, translate, merge, or create derivative works of the App.
• Decompile, decrypt, reverse engineer, reverse compile, or disassemble the App, except where such restrictions are prohibited by applicable law.

4. Third-Party AI Services

The App allows you to create or generate AI content by connecting to third-party AI providers. You acknowledge and agree that:

• The Developer is not responsible for the accuracy, quality, legality, or appropriateness of any AI-generated content.
• Your use of AI services may also be governed by the third-party providers’ own terms and policies.
• You are solely responsible for how you use AI-generated content.

5. Updates

The App may be updated automatically or manually to include new features, bug fixes, or improvements. This EULA will apply to such updates, unless a separate license accompanies them.

6. Privacy

The App itself does not collect personal information. However, Apple may collect depersonalized diagnostic and usage information (e.g., operating system version, application version, device model, and event timestamps) to improve the service.

7. Intellectual Property

All rights, title, and interest in and to the App (including but not limited to software, design, text, images, and trademarks) remain the property of the Developer or its licensors.

8. Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with its terms. Upon termination, you must stop using the App and delete all copies.

9. Disclaimer of Warranties

The App is provided “AS IS” without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits or data, arising out of your use of the App or AI-generated content.

11. Apple Terms

You acknowledge and agree that:

• Apple has no obligation to furnish any maintenance or support services with respect to the App.
• Apple is not responsible for addressing any claims relating to the App, including product liability, legal compliance, or intellectual property infringement.
• Apple and its subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance of the terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you.

12. Governing Law

This EULA shall be governed by and construed in accordance with the laws of Montenegro, excluding its conflict of laws principles.
